These terms govern your use of TheNimantran.com, including our design tools, print ordering services, and delivery operations. Please read carefully.

Section 1

Acceptance of Terms

1.1 Agreement

By accessing, browsing, or placing an order on TheNimantran.com ("the Platform"), you ("the Customer") agree to be legally bound by these Terms & Conditions, our Privacy Policy, Cookie Policy, and Return Policy (collectively, "the Agreements"). If you do not agree to any part of these Agreements, you must not use the Platform.

1.2 Eligibility

You must be at least 18 years of age to place an order or create an account. By using the Platform, you represent and warrant that you are at least 18 years old and have the legal authority to enter into a binding contract.

1.3 Account Registration

You are responsible for maintaining the confidentiality of your account credentials. Any activity occurring under your account is your responsibility. TheNimantran.com reserves the right to terminate accounts that violate these terms, engage in fraudulent activity, or harm other users or the Platform.

Section 2

Ordering & Production

2.1 Order Confirmation

An order is not confirmed until you receive an official order confirmation email from TheNimantran.com. The confirmation includes your order ID, items, quantities, pricing, and estimated production timeline. Price displayed at checkout is final unless explicitly changed due to an error, in which case we will contact you before proceeding.

2.2 Digital Proof Approval

For custom-printed products, a digital proof PDF will be sent to you before production begins. It is your responsibility to carefully review the proof for design accuracy, spelling, dimensions, color intent, and layout. Your approval (explicit or via order confirmation) constitutes acceptance of the file for production. Once production begins, changes cannot be made.

2.3 Production Timeline

Estimated production and delivery timelines are provided in good faith. Express delivery (3–5 hours) is available for select products in eligible locations. Timelines may be affected by high-demand periods, supply chain issues, or events beyond our control. We are not liable for delays caused by force majeure events.

2.4 Cancellation

Orders may be cancelled free of charge within 60 minutes of placement, provided production has not commenced. After production begins, cancellations are not accepted. Please review your order carefully before confirming.

2.5 Minimum Orders

Certain products (commercial stationery, labels, bulk invitations) may have minimum order quantities (MOQ). MOQs are clearly displayed on the product page before checkout. Orders below MOQ will not be processed and will be refunded in full.

Section 3

Pricing & Payment

3.1 Pricing

All prices displayed on the Platform are in Indian Rupees (INR) and inclusive of applicable GST unless stated otherwise. Prices for custom products are calculated based on product type, quantity, material, finish, and delivery option selected.

3.2 Payment Methods

We accept UPI, credit/debit cards (Visa, Mastercard, RuPay), net banking, and popular wallets via Razorpay. International payments via cards are accepted for international shipping orders. Full payment is required at the time of ordering.

3.3 Payment Security

Payment processing is handled by Razorpay, a PCI-DSS Level 1 certified payment gateway. TheNimantran.com does not store your card details on our servers.

3.4 Invoicing & GST

A valid GST invoice is issued for all orders. If you require a GST invoice with your business GSTIN, please provide it during checkout or within 24 hours of placing your order. Amendments to invoices after 7 days of issuance cannot be made.

Section 4

Custom Products & Intellectual Property

4.1 Your Content

By uploading design files, logos, images, or text to our platform, you confirm that you own or have the legal right to use all submitted content, and that it does not infringe on any third-party intellectual property rights, contain defamatory material, or violate any law.

4.2 License to Print

By submitting content for printing, you grant TheNimantran.com a non-exclusive, limited license to reproduce, print, and package your content solely for the purpose of fulfilling your order. We do not use your designs for any other purpose.

4.3 Prohibited Content

We reserve the right to refuse printing of any content that is unlawful, obscene, defamatory, sexually explicit, promotes violence or discrimination, or infringes on third-party intellectual property. Orders with prohibited content will be cancelled and refunded, minus a processing fee.

4.4 TheNimantran.com IP

All design templates, brand assets, Cloud Studio UI, website code, and original content on the Platform are the exclusive intellectual property of TheNimantran.com. Unauthorized reproduction, resale, or distribution of our proprietary assets is strictly prohibited.

Section 5

Delivery & Risk

5.1 Delivery

Delivery timelines are estimates only. Standard delivery is 3–7 business days. Express delivery (3–5 hours) is available for select products in eligible pin codes. Delivery charges are calculated at checkout based on location and order weight.

5.2 Risk of Loss

Risk of loss and title to products pass to you upon delivery to the carrier. Unboxing videos are strongly recommended for all orders to facilitate any damage claims with carriers.

5.3 Delivery Failure

If a delivery attempt fails due to incorrect address information provided by the customer, or if the customer is unavailable and the order is returned to us, re-delivery charges will apply. Unclaimed returned orders may be cancelled after 14 days, with a refund issued after deducting shipping and handling costs.

5.4 International Shipping

International orders are subject to customs duties, import taxes, and regulatory clearance in the destination country. The customer is solely responsible for any such charges. TheNimantran.com is not responsible for delays caused by customs processes.

Section 6

Limitation of Liability

6.1 Service Availability

TheNimantran.com provides the Platform on an "as available" basis. We do not guarantee uninterrupted or error-free service. We reserve the right to suspend, modify, or discontinue any feature at any time without notice.

6.2 Limitation

To the maximum extent permitted by applicable law, TheNimantran.com shall not be liable for indirect, incidental, punitive, or consequential damages arising from your use of the Platform or our services, including lost profits or data loss.

6.3 Maximum Liability

In any event, our total liability to you for any claim arising out of or in connection with your use of our Platform or services shall not exceed the amount paid by you for the specific order giving rise to the claim.

Section 7

Governing Law & Disputes

7.1 Governing Law

These Terms & Conditions are governed by and construed in accordance with the laws of India, including the Information Technology Act 2000, Consumer Protection Act 2019, and other applicable statutes.

7.2 Jurisdiction

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Varanasi, Uttar Pradesh, India.

7.3 Dispute Resolution

We encourage customers to contact us at thenimantran.com@gmail.com before initiating formal legal proceedings. We are committed to resolving disputes amicably and promptly.
